Trademark Registry HQ FAQs

Still have questions? Call 1 (877) 721-4579 with us for real-time support.

What is a trademark and what does it do?

A trademark is a word, phrase, symbol, design, or combination that identifies your goods or services. Registering it gives you nationwide notice of your rights and stronger legal tools to stop confusingly similar use by others.

What is a common law trademark and why bother to register a mark?

Common law rights can arise when you use a mark in commerce, but they are generally limited to the geographic area where you operate. Federal registration creates a public record of ownership and gives your brand broader, more predictable protection.

Should companies trademark their name or logo?

Many companies protect both. A name registration can cover the wording customers use to identify the business, while a logo registration can protect the specific visual design. Each application should reflect how the mark is actually used.

A company has a domain name, so why does it need a trademark?

A domain name only gives you an internet address; it does not establish broad brand rights. A trademark helps protect the name customers associate with your business across websites, products, advertising, and other channels.

What about my slogan, do companies usually register that?

A slogan can function as a trademark when it distinguishes your goods or services rather than merely describing them. If customers recognize the phrase as a source identifier, registering it may be worthwhile.

What you must know before contacting us

Please be aware that we are not a law firm and do not offer legal advice before contacting us. Although we can help with the trademark application process, we cannot ensure that the USPTO will accept your application. It’s important to know that while we do our best to give you accurate and helpful information, the USPTO makes the final decisions. We advise speaking with an expert lawyer who can offer you the necessary professional counsel if you need legal advice or have complicated trademark concerns.

Select what you are trying to protect

Enter the name you wish to protect

Does your mark include a living person’s name—even if a stage name or pseudonym or could it be perceived to include a person’s name?
Does your mark include any words other than English or non-Latin characters?
Are you currently using this trademark in your business?

If you do not have proof now, you can submit proof later after your trademark is submitted to the Trademark office. If you do it later, you will need to pay a $100 government fee (for US trademarks).

Will the trademark be owned by an individual or an entity such as a corporation or LLC?

Identify the owner of the trademark. This is the person or organization who will be the owner of record. If you choose individuals, you can enter as many names as you want who own the mark. With an organization, you will have to identify someone to be the person of contact for the organization.
